Having been on its way for years, after having been split in two recently (reform of bankruptcy with the establishment of restructuring mechanisms on the one hand and, on the other, the introduction of administrative dissolution without liquidation), the draft bankruptcy law is close to the opinion which must be delivered by the Council of State, expected for this fall.
It is therefore a perfect opportunity to analyze it in detail, and in a spirit of positive criticism, to see what may please, what may not please, but also, what is not there and that we would like to see. (such as the digitization of bankruptcy procedures, for example).
