The impact of the ATAD 1, ATAD 2 and DAC 6 directives on international tax practice in Luxembourg
The European Union is strongly mobilized in the fight against aggressive tax optimization by certain large international groups. It has thus translated the progress of the BEPS (base erosion and profit shifting) project of the Organization for Economic Co-operation and Development (OECD) into European law by adopting several "anti-optimization" directives:
The first “ATAD 1” contains provisions, in The line of BEPS project recommendations, relating to The deductibility of loan interest, to controlled foreign companies and to hybrid situations (differences in national legal qualifications leading to a reduction or no taxation) intra-eu.
The “ATAD 2” directive complements The ATAD 1 directive concerning Hybrid relations with third countries to the eu.
The “DAC 6” directive introduced the automatic exchange of information on cross-border tax arrangements, with the aim of increasing tax transparency and enabling tax authorities to react more quickly in the presence of aggressive international tax planning mechanisms. .
These directives, recently transposed into Luxembourg law, are applicable from 2020 and will have a significant impact on Tax practice in Luxembourg.
