DSM Avocats à la Cour is pleased to invite you to a free webinar in French on Wednesday May 25 from 9:00 a.m. to 9:45 a.m. on the theme “The 'new' professional payment guarantee: what are its advantages, and how to implement it? ".

Since the law of July 10, 2020 which introduced the professional payment guarantee, there is a new mechanism in the Luxembourg legal arsenal which makes it possible to fill a gap in positive law with regard to autonomous guarantees.

With the growing importance of guarantees in financial transactions and growing risks, it is now necessary to understand the differences between surety bonds, independent first-demand guarantees and professional payment guarantees.

During this presentation, discover an overview of the various guarantees under Luxembourg law as well as their main characteristics and applications.

Program :

Distinction between suretyship, first demand guarantee and professional payment guarantee;
The new use in practice of these different types of guarantees.
Goals :

Discover the differences between surety and independent guarantee;
Understand the innovations of the Luxembourg payment guarantee introduced by the law of July 10, 2020;
Discover the main characteristics and possible uses of the professional payment guarantee;
Identify the conditions for the application of the law of July 10, 2020 on the professional payment guarantee;
Securing its contracts and guarantees to avoid the risk of requalification;
Discover the feedback from the lawyers of the DSM study since the entry into force of the law.
The webinar will last 45 minutes and an interactive Q&A session is scheduled at the end.

Speakers:

Founding partner of DSM Avocats à la Cour, Me Mario DI STEFANO is responsible for the Corporate / M&A, Tax and Real Estate departments. Mario assists national and foreign clients in the context of acquisitions, disposals and corporate restructuring. He also assists his clients in the context of private equity and corporate finance transactions, and more particularly in the context of transactions for the acquisition or sale of buildings and the development of complex real estate projects. In addition, Mario represents his clients in civil, commercial, administrative and tax disputes.
Marie-Paule GILLEN joined DSM Avocats à la Cour in 2012 as a partner and has since headed the Banking & Finance department. After having exercised management mandates within the KBL Group across Europe and a member of the Committee of European Financial Markets Lawyers of the ECB, Marie-Paule retained those of President of AEDBF Luxembourg, member of the Legal Committee of the BCL, the Board of AEDBF Europe and the Cercle Munster. Since May 2019, she has also been a director of BCEE.
