Whistleblowing is regularly discussed in the press. But aside from these high-profile cases, information leaks - well-meaning or bad-intentioned - can affect any business. The emotion of the moment and the absence of clear procedures can lead to hasty decision-making, such as dismissal or a criminal complaint, which will mark the beginning of a long and exhausting judicial process.
The purpose of this conference is to educate businesses and the public on the subject of whistleblowers.
For these purposes, it is first necessary to analyze the whistleblower criteria "ethical" to understand its social utility and the value of its protection.
Then, the company must prepare for the eventuality of a leak of information. Internal procedures, mandatory or optional, can channel and therefore better control disclosures.
Thus, companies will have to analyze the alert and decide whether it is a good faith denunciation, which should be used to improve internal governance, or whether it is a misinformation that merits consideration of civil, disciplinary and / or criminal sanctions.
