LAUNCH CONFERENCE OF THE NEW INTERNATIONAL REVIEW OF INTELLECTUAL PROPERTY AND DIGITAL LAW - PIN CODE
Informational heritage, know-how and business secrets of companies: how to protect them and deal with cyber attacks?
Presentation
No doubt more than ever the activity of any company is based on its information heritage: data (whether personal or not) is the raw material of any society.
It is therefore crucial that companies protect their information assets, their know-how and their business secrets and guard against attacks of a new kind that are computer attacks.
To face this challenge, various concrete and legal measures exist or are developing to support companies in setting up systems of ethical protection: crackdown on cybercrime, hacking ethics or transposition of the European directive 2016/943 protecting the business secrets.
But concretely, what are the main computer attacks that companies face? What is the legal arsenal framing these attacks as well as protective measures like ethical hacking?
These are the themes chosen by the committee of the new PIN CODE magazine at its launching conference.
After a concrete review of the main computer attacks that companies face, a real case study of a management of a data breach following a major computer attack will be exposed. Then, the legal framework will be analyzed in more detail by addressing the criminal aspects of cybercrime, the development of ethical hacking and the question of the legality of it. Finally, a critical analysis of the "Secrets d'affaires" directive and its transposition into Belgian, French and Luxembourg law will be presented.
